Our client, located at a marine facility, asked for help assessing a potential settlement of alleged Clean Water Act violations arising from California’s General Industrial Stormwater Permit. Working through the penalty factors with our client and noting where we should push the agency to exercise its discretion in our client's favor, we helped reduce the proposed penalty by almost 30%, representing about half of the maximum potential penalty, and allowing our client to settle.
