DTSC Settles to Prevent Lawsuit

We’ve finalized a settlement with DTSC to avoid an enforcement lawsuit under the Health & Safety Code arising from our client’s transportation of hazardous waste to a facility that was not yet permitted. Although DTSC alleged that our client, a medical and research facility, had engaged in the activity over a three-year period, the agreement provided for a limited penalty, almost half of which was paid as supplemental environmental projects.
